Your use of this Website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers set out below ("terms and conditions"). You should read them now. Your use of this Website constitutes an agreement by you to these terms and conditions.
GoGo Shop reserves the right to amend the terms and conditions at any time and without notice to you. Your continued use of the Website after amendments constitutes your agreement to abide by and be bound by the amended terms and conditions.
Capacity
In using this Website you undertake to GoGo Shop that you have legal capacity to enter into a binding Contract.
Order
By placing an order on this Website you are making an offer to purchase the particular product for the price (including delivery and other charges and taxes) as specified on this Website at the time you place the order. GoGo Shop at all times reserves the right to accept or reject your offer for any reason, including but not limited to, the unavailability of any product, an error in the product description or price. No contract comes into the existence with GoGo Shop until GoGo Shop forward a confirmation of receipt of your order and payment.
When placing an order it is your responsibility to ensure all details conveyed in the orders are true and correct. GoGo Shop does not accept any liability for products sent with errors made by you in ordering.
All payment must be made prior to delivery by credit card acceptable to GoGo Shop. No order will be accepted without payment.
Prices
Prices of products and services are current at the time of issue but are subject to availability and may change at any time. All prices displayed are inclusive of GST but exclude postage, insurance and handling which will be quoted seperately at the time of placing of your order and will be dependant upon the size, weight and destination of your order.
Goods and Services Tax ("GST") and other taxes
Prices displayed on this Website are inclusive of GST applicable to Australia being ten per cent (10%). The products and services on this Site are not available for delivery outside Australia. You are responsible for any other taxes, duties and liabilities imposed by any other Governmental Agency.
Delivery
Delivery will be made by courier or Australia Post and you should allow approximately fourteen (14) days for delivery to be made. The delivery estimations are indicative only and GoGo Shop will not be liable for any failure to deliver strictly within the estimated times.
If deliveries are made by courier you will be informed of the carrier and GoGo Shop will not be liable for any delays incurred in the delivery. You acknowledge that delivery will be made to the address you have provided and you undertake to GoGo Shop and the carrier that someone will be available at the address to take delivery.
You acknowledge that at times delays may occur and GoGo Shop will not be liable for any delays whatsoever.
Risk and title
GoGo Shop will retain title to the products you will order until you have made payment in full for those products but all risk in the product will pass upon their delivery to or collection by Australia Post office or courier service.
Refunds
There will be no refund or return of product unless strictly required by the applicable Laws of Australia or the product is defective. Any manufacturing faults or defects will be covered by the manufacturers warranty only unless otherwise required by Australian Law.
Defective Items
Should you claim an item is defective you must advise us in writing within seven (7) days of delivery of the product to be eligible for the replacement item. Items will be replaced within a reasonable period of time subject to availability. For products that cannot be replaced a full refund will be made if we accept that the product was defective.
How to return a defective item
- You must contact GoGo Shop at info@gogoshop.com.au within seven (7) days of delivery of the allegedly defective product and provide details of the alleged defects. A representative will evaluate your return request and record all the necessary product return information and issue you with a Return Authorisation Number ("RAN").
Provided we accept that the item is defective you will be provided with address details of where to send your return.
You should not send your item without a RAN. - Return to address with your RAN clearly displayed on the packaging.
- As soon as the return has been received a replacement product (if available) will be forwarded to you.
- Please note any return item must be received by GoGo Shop within fourteen (14) days of the issue of the RAN.
- Replacement product will not be forwarded until after the faulty item has been received by GoGo Shop and accepted as defective.
- All returns must have a RAN
- Products that are returned to GoGo Shop without a RAN will be returned to sender.
Limitation and liability
GoGo Shop will in no way be liable for any direct , indirect, incidental, special or consequential damages resulting from use or inability to use the Website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the Website or resulting from unauthorised access to or alteration of your transmissions or data or of any information contained on this Website, including but not limited to, damages for loss of profits, use, data or other intangible, even if GoGo Shop has been advised of possibility of such damages.
Where an Act of Parliament implies in the terms and conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in the terms and conditions however, the liability of GoGo Shop for any breach of such term, condition or warranty shall be limited, at the option of GoGo Shop, to any one or more of the following:
- If the breach relates to goods:-
- The replacement of the goods or supply of equivalent goods
- The repair of such goods
- The payment of the cost of replacing the goods or of acquiring equivalent goods
- The payment of the cost of having the goods repaired; and
- If the breach relates to services:-
- The supplying of services again; or
- The payment of the cost of having the services supplied again.
Disclaimer
While the information contained in this Website is believed to be accurate and current, it is provided by GoGo Shop in good faith on an "as is" basis. GoGo Shop, its management, officers or employees make no representation or warranty as to the reliability, accuracy or completeness of the information contained on the Website and none of them accept responsibility arising in any way (including negligence) for errors in, or omissions from, the information contained in the Website. To the extent (if any) that if the content of the Website does not satisfy the laws of a country other than Australia, it is not directed to persons in those countries and they should not use the Website.
